Am I A Candidate For Mediation?
Mediation is not for everyone. In order to successfully mediate a dispute, both parties must be able to communicate in an attempt to resolve the important issues. In some cases, physical and/or mental abuse restricts such communication and prevents the possibility of conciliation.
In general, ideal candidates for mediation:
- Have a desire to work together to reach an amicable resolution to their dispute
- Wish to remain on good terms after the dispute
- Understand that compromise is an important component to this process
- Desire to keep the costs of their case low.
What Is Mediation?
Mediation is a process designed to help both parties resolve their dispute without the need for drawn out, contentious litigation. A neutral third party, the mediator, will meet with both parties of the case and facilitate constructive communication aimed at resolving the dispute. Mediation often results in a settlement agreement that more accurately reflects the best interests of both parties.
When opting for mediation, neither party is required to be represented by counsel, but both parties are free to bring counsel if desired. Since the mediator is hired as a neutral, objective third-party to the case, Greta cannot offer legal advice to either party. Her role is simply that of a facilitator and scribe. Greta will draft the terms that you have agreed upon, oftentimes during the meeting itself. If complete, the parties can sign the agreement before they leave the mediation.
Sometimes the parties have already reached an agreement before they contact a lawyer, and in this case, they don’t really need a mediator. Often the parties just need someone to draft the paperwork to get them through the divorce process. This is not mediation, but Hoffman Walker & Knauf can handle this sort of arrangement. In such a case, our attorneys would represent only one of the parties, and the other party has the option to participate Pro Se (without representation), or at any time in the process can seek advice from other legal counsel.
